In this rare and singular in-house role, where no two days are alike, corporate counsel will engage with executive leadership in a non-hospital setting and be a core contributor on multifaceted complex legal and complicated compliance matters that are absolutely essential to the organization's mission of providing quality healthcare to all Idahoans, irrespective of their financial ability to pay.

GENERAL RESPONSIBILITIES

The Corporate Counsel/Compliance Manager oversees Terry Reilly's corporate compliance and risk management and health Information portability and accountability act (HIPAA), 42 CFR Part 2, and the Federal Tort Claims Act. As corporate counsel, this role serves as an in-house representative for issues including but not limited to healthcare governance, contracts, insurance, employment law, and property. This position functions as an independent and objective body that reviews and evaluates compliance and legal issues/concerns within the organization. The position ensures compliance with federal, state and local rules and regulations, company policies and the company's standards of conduct. This position is a channel of communication to receive and direct compliance issues to appropriate resources for investigation and resolution.

ESSENTIAL DUTIES

  • Oversight of HIPAA Privacy, including the investigation of compliance and incidents. Ensures follow-up on corrective action and notifications.
  • Management of FTCA coverage, including leading any litigation for FTCA, complaints to licensing boards, HR claims and insurance claims.
  • Negotiation, review and oversight of corporate contracts for services, vendor and employment contracts.
  • Collaborates with other departments (e.g., Risk Management, Human Resources, HIM, and executive leadership) to direct compliance issues to appropriate existing channels for investigation and resolution.
  • Identifies potential areas of compliance vulnerability and risk; develops/implements corrective action plans for resolution of problematic issues, and provides general guidance on how to avoid or deal with similar situations in the future.
  • Oversight of corporate insurance coverage outside of FTCA such as general liability, employee benefit coverage, crime coverage, etc.
  • Ensures proper reporting of violations or potential violations to duly authorized enforcement agencies as appropriate and/or required.

MINIMUM QUALIFICATIONS

  • Juris Doctorate
  • A minimum of 3 years' experience in a healthcare organization or HIPAA Compliance function with litigation, regulatory, and transactional experience.
  • Familiarity with operational, healthcare, HIPAA and 42 CFR Part 2 compliance, FTCA, contracts, real estate, general civil litigation and human resource procedures and regulations.
  • Knowledge of applicable federal and state privacy laws, including the Privacy Rule, and TR's information and privacy practices.
  • Experience in contract language and compliance in areas of employment, BAA's, and MOU's.
  • Demonstrated leadership, organization, facilitation, communication, and presentation skills.
  • Familiarity with cultural competencies and limited English proficiency guidelines.
  • Experience in health information access controls, release of health information, and health information release control strategies and technologies.

PREFERRED QUALIFICATIONS

  • Master's degree in Medical Records Administration or compliance related law degree.
  • Experience with applicable federal and state privacy laws, including the Privacy Rule, information and privacy practices.
  • Experience in health information access controls, release of health information, and health information release control strategies and technologies.
  • A minimum of 5 years' experience in Corporate and HIPAA Compliance within Healthcare.
