Under the direction of the Senior Vice President -- Chief Compliance and Privacy Officer, responsible for leading the day-to-day management and implementation of the Mercy Compliance Privacy Program which includes, but is not limited to: HIPAA Privacy, Negotiating/Approving Business Associate Agreements, interactions with the Office for Civil Rights and other governmental authorities. Leading the development of: 1) A Mercy-wide Risk Assessment process and subsequent efforts to reduce/eliminate any identified risks, 2) Auditing and Monitoring to detect, correct, and mitigate privacy violations and/or other privacy compliance issues, 3) Further expansions of FairWarning enforced policies across Mercy, 4) Privacy Education for Adult Learners, including developing multiple methods of disseminating this education, including via computer, in person, Baggot Street, co-workers who speak English as their Second Language, etc. Ensuring compliance with all federal and state healthcare laws and regulations impacting privacy, including those required by a Corporate Integrity Agreement ("CIA"), as applicable. If Mercy is under a CIA and as requested by the SVP -- Chief Compliance and Privacy Officer, collaboratively works with the Independent Review Organization ("IRO"), Office of Inspector General ("OIG"), Department of Justice ("DOJ") and any other governmental representatives to demonstrate Mercy's commitment to compliance and adherence to the requirements of the CIA. Educates and assists Mercy operational leaders with meeting compliance obligations, including those required by a CIA, if applicable.

Responsibilities and QualificationsSupports the leadership and direction of the Senior Vice-President, Chief Compliance and Privacy Officer regarding all aspects of privacy compliance, including working with and through the compliance officers, privacy officers, local senior operational leaders, and local regional and front-line operational leaders at each Mercy Community, including Mercy senior operational leaders at the Ministry office.Oversees audits and other reviews to provide feedback and to identify any needed corrective action operational leaders need to undertake in order to achieve and maintain compliance with all privacy healthcare laws and regulations.

Interaction with Governmental Representatives

Collaboratively works with the OCR and other governmental representatives to demonstrate Mercy's commitment to compliance and adherence to all privacy healthcare laws and regulations.Working with operational leaders, ensures that developed internal controls are followed to notify the OCR within the timeframes required law of any breaches which exceed 500 patients or that meet other requirements for governmental notification.

Education and Training

Develops a robust privacy education plan for Mercy which includes consideration of the following but is not limited to: 1) Educational and training materials for adult learners; 2) Educational and training materials for co-workers who speak English as a second language; 3) In person education; 4) Newsletters or email blasts; 5) Use of the Compliance Hub on Baggot Street.Takes appropriate action with Human Resources or senior operational leaders in the event a co-worker fails to complete required education.

Board Responsibilities

As requested by the SVP -- Chief Compliance and Privacy Officer, reports quarterly to the specified Board Committee regarding privacy matters, including issues related to OCR or governmental investigation from other agencies.

Policies and Procedures

Working with SVP -- Chief Compliance Officer, other regional local compliance officers, and other operational leaders, develops policies and procedures as required by Mercy's Compliance Program, including any CIA, if applicable.Ensures the Notice of Privacy Practices is periodically reviewed, updated, posted and otherwise disseminated as required by the healthcare law and regulation.

Risk Assessment, Mitigation and Reportable Events

Working with SVP -- Chief Compliance Officer, other regional local compliance officers, and other operational leaders, develops an annual risk assessment and mitigation plan, pertaining to any compliance or privacy issue, including any issues covered by any CIA.Ensures that Mercy's performance is compared annually against the HIPAA Privacy Audit Protocol with an assessment of risk and prioritization completed, and appropriate actions plans are developed and implemented.Reports out status of Risk Assessment, HIPAA Privacy Audit Protocol and other significant privacy matters to designated committees.

Travel

Up to 25% travel may be required for this position.

Qualifications:

Education:

Doctor of Jurisprudence, Master's degree in Business Administration, Healthcare Administration or other related degree

Experience:

Five years experience in a healthcare compliance environment with specialized experience in HIPAA Privacy and Security, as well as state privacy laws.

* Preferred Qualifications

Seven to ten years experience in a healthcare compliance environment with specialized experience and HIPAA Privacy and Security, as well as state privacy laws.

Certification/Registration:

Membership in the Missouri Bar or eligible for reciprocity

Certified in Healthcare Compliance from the Healthcare Compliance Association.

Certified in Healthcare Privacy Compliance from the Healthcare Compliance Association.

Certified in Healthcare Research Compliance from the Healthcare Compliance Association.
